Terms of Service

1. Description of Service

SafeFrame is a mobile application and related backend services that allow kindergartens and preschools ("Institutions") to publish photo albums to authorized parents and staff. Features may include account sign-in, device registration, photo upload and review by staff, privacy processing (such as face blurring), and viewing of published images.

2. Eligibility and Accounts

• Adult users: The Service is intended for parents, guardians, and authorized Institution staff who are at least 18 years old (or the age of majority in their jurisdiction).
• Accurate information: You agree to provide accurate registration information and to keep your credentials confidential.
• Institution access: Access may depend on your Institution's approval, group membership, or device linking rules configured for that Institution.

3. Fees and Purchases

SafeFrame does not offer in-app purchases or consumer subscriptions through the mobile app unless explicitly stated in the store listing. Any fees for the Service, if applicable, are arranged between you and your Institution or Digital Circle under a separate agreement.

4. Intellectual Property

Your content: Institutions and their authorized staff retain rights in photos and metadata they upload, subject to licenses needed to operate the Service (hosting, processing, display to authorized viewers).

Our Service: The SafeFrame app, software, branding, and documentation are owned by Digital Circle LLC and its licensors. You may not copy, reverse engineer, or misuse the Service except as allowed by law.

5. User Content and Responsibilities

Photos and related materials uploaded or processed through the Service ("User Content") are primarily controlled by the Institution and its staff. By using the Service, you represent that:

• You have authority to use the Service for your Institution or as a parent/guardian linked to a child enrolled through your Institution.
• Uploads comply with applicable laws and Institution policies, including consent and privacy rules for photographing minors.
• You will not upload unlawful, abusive, or infringing content.

Digital Circle provides infrastructure and tools; Institutions remain responsible for what they publish to parents and for obtaining necessary consents.

6. Privacy and Security

Our Privacy Policy describes how we handle personal data. The Service may use device linking and screen-protection features where supported; no security measure is perfect, and you use the Service at your own risk for residual technical limitations.

7. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Digital Circle LLC, its officers, employees, and agents from claims arising from your misuse of the Service, your User Content, or your violation of these Terms or third-party rights.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation or error-free photo processing.

9. Limitation of Liability

To the maximum extent permitted by law, Digital Circle LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill, arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Continued use after changes constitutes acceptance.
